What Are the Different Types of Property Documents?

Given below are some property documents:

1. Sale deed/ Title deed

1. Sale deed/ Title deed

  • Used as proof of transfer of ownership of property from seller to buyer.

 

  • It is needed during sale of the property.

 

  • It might be needed as a guarantee to get a loan.

 

  • The property must be registered with the registrar along with a record of the Title deed.

2. Land Patta

2. Land Patta

  • Issued by village accountant.

 

  • It has details on extent of land, barren/cultivable land, buyer, seller and tenant names.

 

  • It also has other details like soil type, mortgage and legal charges on property and the date on which property was converted from agriculture to non-agriculture use.

 

  • A copy of Land Patta is important (not the original) for buying the property.

3. Khaata Certificate

3. Khaata Certificate

  • It is an entry in the local municipal office records.

 

  • It confirms that the property has been constructed as per the rules.

 

  • It is important for registration and transfer of property.

 

  • Original Khaata Certificate will be needed while applying for a home loan.

4. Mutation registration

4. Mutation registration

  • It is similar to Land Patta.

 

  • It is important if the property is built on converted land (agriculture to non-agriculture).

 

  • Original copy of Mutation registration is not always needed.

5. Joint development certificate

  • It is an agreement.

 

  • It is for cases where the seller (land owner) contributes the land and buyer (builder) undertakes development activity on it.

 

  • It proves who the owner of the property is.

 

  • Its original copy is not needed.

6. General Power of Attorney

6. General Power of Attorney

  • It is a document which allows a person to do certain things on behalf of someone else.

 

  • For example, if a buyer (B) hands over Power of Attorney to a person (P), P becomes B’s legal representative who can take legal and financial decisions including the sale or purchase of property on B’s behalf.

 

  • It is an important document and must be in its original form.

  • They are government approvals for electricity supply, water supply, etc.
  • A builder must have NOCs before the start of construction of a property.

8. Ratification Certificate

8. Ratification Certificate

  • Also called supplementary agreement. In case there are any changes that are made in the original document, this certificate authenticates the changes.

 

  • In case you are unaware of any changes made in the original document, this certificate helps in avoiding any future shocks.

 

  • The original copy isn’t required.

9. Allotment Letter

9. Allotment Letter

  • It is issued to the buyer by the builder/ housing society at the time of applying for a bank loan to buy the property.

 

  • It mentions the amount of money already paid to the builder by the buyer.

 

  • This document must be kept in its original form.

10. Possession Letter

  • It confirms the delivery of the property from builder to the buyer on the date mentioned in the letter.
  • It should be kept in its original form.

11. Payment receipts

  • When buying a property, collect the original payment receipt from the builder as a solid proof of payment.
  • The original is required.

12. Encumbrance Certificate

  • This certificate has the details of all the transactions with the property since purchase from the first seller.

 

  • It confirms the status of current owner.

 

  • Original copy of this certificate is required.

13. No dues certificate

  • A no dues certificate is a certificate that the Apartments Owners Association needs to ensure that the owner has cleared all necessary payments related to the house.
  • This is also required in its original form.

14. Completion certificate

It is issued by the municipal authorities. It shows whether a property complies with the rules like allowed building height, distance from the road, etc.

  • It is proof that the building was constructed according to the approved plan.

15. Occupancy certificate

  • It is issued when the construction of a property is completed and is ready to be occupied.
